An update to a story we told you about last week regarding would-be homebuyers in a new housing development in Elora having their agreements terminated.
The future homebuyers received a notice last week stating their agreement of purchase and sale by the Guelph building company Gemini Homes, had been terminated and their deposits would be refunded.
In an updated statement Gemini Homebuilders said Centre Wellington Township inspects and approves utility installations when complete and Haylock Farms Ltd., the developer, is responsible for arranging installation of hard services.
It went on to says that the completion date and scope for hard services as referenced in the Agreement of Purchase and Sale were established by Gemini Homes and not the township or the developer, and when the completion date was not met the agreements were automatically terminated.
In the original press release sent by the company, wording was used that suggested the township was to blame for the date being missed.
Mayor Kelly Linton said in an interview with The Grand at 101 that township staff met with Gemini Homes last week and Gemini has since clarified its wording.
Linton said the date of January 13,2022 was not a date set by the township.
He says those services need to meet township requirements.
Some purchasers reached out to The Grand but were afraid to speak on record because they still want to live in the subdivision as planned and don’t want to jeopardize any comprises or plans that could be proposed.
All of the purchasers that did reach out agree that they feel Gemini Homes wanted to profit of the current housing market.
Gemini says it is open to having discussions with the purchasers in an attempt to find a mutually acceptable solution for all parties in the circumstances.
